New Delhi, September 19, 2026 – India’s food safety regulator, the Food Safety and Standards Authority of India (FSSAI), has initiated legal action against Nestlé India Limited by filing three separate adjudication cases related to its infant nutrition products.
The action covers promotional claims made for two popular baby formulas and a laboratory finding on a third product.
Promotional Claims Flagged
FSSAI examined Nestlé’s infant nutrition products and their promotional material available on e-commerce platforms. It specifically flagged:
NAN Excella Pro Stage 1: Claims relating to “5 HMOs” (Human Milk Oligosaccharides) and “Whey Protein.”
Lactogen Pro 1: A claim stating that its “Whey Protein” is easy to digest.
The regulator sought clarifications from Nestlé India. After review, FSSAI stated that both products were in contravention of:
Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020, which restricts promotional claims or material intended to increase the saleability of infant foods, and
Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992 (IMS Act), which prohibits the advertisement and promotion of such products.
Biotin Content Issue
Separately, a sample of a Nestlé India follow-up formula was found to be “sub-standard with respect to biotin” (Vitamin B7) during laboratory analysis. The sample was referred for re-analysis, and the referral laboratory also confirmed it was non-conforming with the prescribed biotin requirements under the 2020 infant nutrition regulations.
FSSAI has not ordered a product recall at this stage.
Nestlé India’s Response
Nestlé India has rejected the non-compliance charges. A company spokesperson stated: “Our products are fully compliant with all the applicable regulations. The said products (i.e., NAN EXCELLA PRO & LACTOGEN PRO) and their labels were approved by the expert committee of FSSAI.” The company added that it will continue to work closely with the regulator and support efforts toward consumer awareness.
